Summary
The matter of the case is a breach of a visiting arrangement concerning a child in the context of a divorce case. The mother (a French citizen living in France) prevents the father to communicate with the child. Court decision: Spanish courts are not competent to decide on the case according to Spanish law and Brussels II a Regulation (generic reference). The plaintiff should suit the defendant in France.
