Summary
The court of the second instance found that the debtor was not served with the document, which instituted the proceedings by the French court, which issued the judgment. Consequently, the Polish court stated that the judgment issued by the French court cannot be, according to Article 34 point 2 of the Brussels I Regulation, declared enforceable.
