Summary
The plaintiff filed an application for divorce against her husband, who lived in Germany. The Polish court found that the defendant had earlier brought the proceedings relating to divorce before a German court. The Polish court, according to Article 19 par. 1 of the Brussels II bis Regulation, stayed its proceeding of its own motion.
