The plaintiff filed an application for divorce. He stated that he and his wife had lived in the UK since 2007. The Polish court stated that, in the light of the provisions of the Brussels II bis Regulation, both the parties have their habitual residence in the UK. Therefore it concluded that it had no jurisdiction under the Brussels II bis Regulation.
