Summary
The court of first instance rejected the application for augmentation of maintenance obligation on the basis of Polish provisions. The court of second instance agreed with the court of first instance but it emphasised that the court should have established that it had had no jurisdiction on the basis of the provisions of the Maintenance Regulation and not of the Polish ones.
