Summary
The plaintiff being domiciled in B. (Germany) claimed for damages because of a traffic accident that had taken place in Italy. The defendant was an insurance company based in Italy who had insured the involved car. The court had to examine the international jurisdiction of German courts. It held that German courts were pursuant to Art. 9, 11 Brussels I internationally competent if the injured party domiciled in Germany had brought an action directly against the insurer. This interpretation of Art. 9, 11 (2) Brussels I has been confirmed by the CJEU in Odenbreit (C-463/06). It is in accordance with this jurisdiction and therefore is correct.
