Summary
The parties argued about claims from a timesharing contract concerning a holiday home in Spain. The contract contained a jurisdiction agreement in favour of Spanish courts.
The court held that German courts were internationally competent pursuant to Art. 23 (5), 22 no. 1 Brussels I. The contract concerned ‘tenancies of immovable property’ within the meaning of Art. 23 no. 1.
In the present case the contract clearly was directly connected to the rent of the holiday houses. This aspect was the main purpose of the contract. The judgment is correct
