Summary
The plaintiff brought an action for payment for hospital services. The plaintiff runs a private hospital and is based in Germany. The defendant is a consumer based in the Netherlands. The plaintiff runs a website in Dutch where there is an extra service for Dutch customers containing forms in Dutch. The court had to examine the international jurisdiction of German courts. It held that the jurisdiction under Art. 15 (1) (c) was given if the professional offered on his website special services and forms in a certain language (here: Dutch) and therefore directs professional activities to that Member State. The judgment is in accordance with settled case law and therefore is correct.
