Summary
A foreign company had been sued for compensation for non-performance of the contract of sale. The Polish court stated that it has jurisdiction under article 5 point 1 of the Brussels I Regulation, because the goods – according to the contract – should have been delivered in Poland. The law applicable has been established on the basis of Article 4 par. 1 letter a of the Rome I Regulation.
