Summary
The plaintiff filed a claim for payment, of remuneration against three companies; one polish and two French. The court of the first instance stated that it has jurisdiction only in the case against the Polish company (according to Article 19 point 1 of the Brussels I Regulation). The plaintiff carried out his work in France in light of Article 19 point 2 letter a of the Brussels I Regulation. What is more, the court of the first instance found that Article 6 par. 1 of the Brussels I Regulation cannot be applied because the claims are not so closely connected that it was expedient to hear and determine them together to avoid the risk of irreconcilable judgements resulting from separate proceedings. The plaintiff appealed against the decision of the court of the first instance. The court of the second instance stated that according to the CJUE the rule of special jurisdiction provided for in Article 6 par. 1 of the Brussels I Regulation cannot be applied to a dispute falling under Section 5 of Chapter II of that regulation concerning the jurisdiction rules applicable to individual contracts of employment.
