Summary
The claimant seeks to enforce his right of contact and right to personal relationship with his child, B.H. (of whom he is the biological father). The right to a personal relationship is not strictly speaking a matter of the status of natural persons. However, it is a matter set within the wider context of extra-patrimonial family relations which are excluded from the scope of the Brussels I Regulation. The original defendants are resident in the Grand Duchy of Luxembourg, but have the Belgian nationality. The Court applies Art. 15 Belgian Civil Code and determines it has jurisdiction.
