Summary
The buyer entered an appearance without contesting the jurisdiction of the court. Pursuant to Art. 24 Brussels I, a court of a Member State before which a defendant enters an appearance shall have jurisdiction, unless the appearance was entered to contest the jurisdiction. Since this isn’t the case, the Belgian courts have international jurisdiction. Under national law, the Commercial Court of Hasselt has jurisdiction. The Court correctly applies Brussels I.
