Summary
The law firm C.B. assisted a company called K.R. in a criminal case which K.R. had joined as a civil party. This company was covered by legal insurance by insurer A. The insurance company contests the statement of fees and costs sent to it by C.B. The Court considers that the law firm consulted by a person covered by legal insurance is the beneficiary of the insurance policy. It is bound by the policy and most notably, by the policy limit. Since the action is brought by the law firm in its capacity of beneficiary, the insurer may be sued in the courts of the place where the lawyer is domiciled, pursuant to Art. 9 Brussels I Regulation.
