Summary
The proceedings were in respect of the contact arrangements for the parties’ children. The children were aged nine and six.
In 2006, the mother had been given the permission to remove the children from the jurisdiction. Contact arrangements were made for the father to see the children.
In 2012, the mother refused to allow for contact.
The father made an application before English courts, seeking an order restoring the status quo.
Although the children were habitually resident in Ireland, the English court assumed jurisdiction under Article 12(3) of Brussels IIa.
