Summary
The defendant has Dutch nationality and is resident in the Netherlands.
The applicant has Belgian nationality and is resident in Belgium. During their marriage, they were both resident in Belgium.
In the case at hand the mother asks the court to order the father to produce his bank statements in order to determine his income. He has already been ordered to pay maintenance to the mother and children.
The Court decides that the Belgian Courts have jurisdiction, according to Regulation 44/2001, Art. 5(2).
