Summary
Divorce and parental responsibility case raised before Spanish courts and resolved on the basis of Brussels II a Regulation provisions. Key facts: determination of the custody rights on the children of a divorced couple in Spain. Court decision: the court takes into account the concept of “best benefit for the child” from arts. 12.1.b, 12.3.b, 15.1, 15.5 and 23 of Brussels II a Regulation in order to decide on the custody of the children of the divorced couple. The court decides to attribute the parents a joint custody of the minors.
