Summary
Pursuant to Article 5(1)(b), first indent, of Regulation (EC) No 44/2001, Italian courts do not have jurisdiction over a claim for the payment of the goods delivered in Germany by the Italian seller to the German buyer. It is irrelevant that the obligation in question is that of payment.
