Summary
Pursuant to Article 23(a) of Regulation No 44/2001, Italian courts do not retain jurisdiction over a claim for breach of contract filed by an Italian company against an English company due to a clause conferring jurisdiction to English courts which, even if not expressly signed, was included in a contract that has been entered into between entrepreneurs and that is not a standard contract.
