Summary
Application of Brussels IIa Regulation provisions to a divorce and parental responsibility case in Spain. The matter of the case is the determination of a joint custody of a minor, son of a divorced couple. A first instance Spanish court attributed joint custody to the parents. A second instance court confirmed that judgement. The claimant appeals against that latter decision. Court decision: the court confirms first and second instance court decisions that attributed joint custody to both parents in the best benefit of the child according to arts. 12 and 15 of Brussels II a Regulation.
