Summary
Pursuant to Article 19(2)(a) of Regulation (EC) No 44/2001, an employer domiciled in a Member State may be sued in another Member State before the courts of the place where the employee habitually carries out his work. A dispute concerning an employment relationship between a flight assistant and a Belgian air carrier carried out on airplanes flying the Belgian flag falls under the jurisdiction of Belgian courts and not of Italian courts.
