Summary
A dispute between a purchaser domiciled in Italy and his/her foreign counterparties arising out of a contract relating to the purchase of the right to use immovable properties on a timeshare basis for touristic purposes pursuant to Directive 94/47/EC – which does not qualify as a contract where the organisational aspects of the trip are prevailing and whose main object is the granting of the right to use an apartment in a tourist village in Spain – falls within the scope of Article 22(1) of Regulation (EC) No 44/2001. Accordingly, Italian courts do not have jurisdiction over the aforesaid dispute.
