Summary
Regulation No 864/2007 Rome II is not suitable for application in order to determine the court having jurisdiction [!!!] in a dispute concerning the damage arisen in 2007 following the delivery of goods proved damaged; indeed, pursuant to Articles 31 and 32 it is applicable to events giving rise to damage which occur after its entry into force, namely 11 January 2009.
