Summary
Pursuant to Article 5(1)(b) of Regulation (EC) No 44/2001 Italian courts have jurisdiction over a claim - brought by an Italian company against an English company - for damages arising out of an alleged termination ad nutum of the commercial relationship between the parties, that has to be characterised as a “contract relating to the sale of goods” under Art. 5(1)(b) first indent of Regulation (EC) No 44/2001, if the place of the actual delivery of the goods is located in Italy.
