Summary
Subject to the Dispute was relation between Brussels IIa and the Hague Convention on the protection of children. The court held that the child’s habitual residence could not be derived from the parents’ habitual residence. The court stated Denmark as the place of the child’s habitual residence. It applied the Hague Convention and came to the conclusion that Danish courts were internationally competent.
