Summary
Parental responsibility proceedings. The court held that Art 10 established an exception to Art 8 given the case of wrongful retention of the child. It further stated that it was not possible to appeal against a family court’s decision not to proceed pursuant to Art 15 (1) Brussels IIa, § 13 a IV, V German Code on the execution of certain instruments in international family law (IntFamRVG).
