Summary
Subject of the dispute was the recognition of a Greek judgment given by the Muftia Court in Komotini. The court stated that although the judgment was given before the Brussels IIa Regulation came into force, the recognition of the judgment was to be assessed under the Regulation’s provisions, Art 64 (1), (3) Brussels IIa. Further, it held that the judgment could not be recognised because the children have not been heard within the Greek proceedings, Art 23 (b) Brussels IIa.
