Summary
The parties argued about the parental responsibility, particularly the change of the child’s name. The mother claimed that the name negatively influenced the child’s mental health. The court held that Brussels IIa applied to the case, Art 61(a). Further, the German courts had the international jurisdiction pursuant to Art 8(1) Brussels IIa as the child had his habitual residence in Germany.
