Summary
Parental responsibility dispute. Parents and child had the Romanian citizenship. The mother lived in Germany with the child. The German family court had ordered that the parental responsibility party is to be withdrawn. The mother appealed against this decision. The court confirmed the first instance court’s judgment. It held that the German courts were internationally competent pursuant to Art 8 (1) Brussels IIa which preceded national rules. It exhaustively ruled the issue of international jurisdiction.
