Summary
After the parties decided to get divorced, the wife moved to Austria whereas the husband stayed in Germany. The court stated that German courts were internationally competent pursuant to Art 3 (1) (a) second indent Brussels IIa as the last common habitual residence was Germany and the husband still lived there.
