Summary
The subject of the dispute was an application for the return of the children. The court held that in this constellation the principle of urgency in Art 11 Hague Convention on Child Abduction in connection with Art 11 (3) Brussels IIa prohibited the order for a guardian ad litem if the court is convinced that he would not bring any new aspects to the dispute. Otherwise the proceedings would be delayed. The court ordered the return of the children.
