Summary
The court was charged with the application for the order of a penalty payment. The father claimed that the mother did not comply with the regulation on the rights of access the parents had previously -before the Local Court- agreed on. The court held that Brussels IIa applied to the case, Art 1 (2) (a). The first instance court had the international jurisdiction pursuant to Art 8 (1) Brussels IIa.
