Summary
The proceeding concerned a German wife and her Indian husband, both living in Germany. The marriage had been concluded as a mere marriage of convenience. The court held that the Brussels IIa Regulation pursuant to Art 1 (1) (a) applied to the annulment of the marriage. The court stated that German Courts had the international jurisdiction pursuant to Art 3 (1) (a) second indent.
