Summary
The court was charged with the assessment of an application pursuant to Art 16 Hague Convention on Child Abduction. The mother had brought her children to Germany contrary to a Swedish court’s judgment which had ordered that the children should live in Sweden with their father.
The court stated that the application could not be successful given the fact that the requirements of Art 19 (2) Brussels IIa were fulfilled. The mother herself had initiated proceedings on parental responsibility before a Swedish court.
