Summary
The dispute concerned an action for damages. The claimant had bought worthless bonds from a stock company based in Switzerland. The court stated the international jurisdiction of German courts under the Lugano Convention (Art. 5 no. 3). The court further held that the law applicable to the purchase of bonds that has taken place after 11 January 2009 was to be derived from Art 4 (1) Rome II Regulation. The court stated that German law applied to the case.
