Summary
The subject concerned statements in an advertisement for medical devices made by the defendant. The claimant is an association which according to its regulations fights against unfair competition.
The court held that German courts were internationally competent under Art 5 no 3 Brussels I. It stated in this regard that the effects of the activity were also located in Germany which justified the application of the provision.
It further found that German law applied to the case. Given the fact that the defendant intended to reach consumers in Germany, their interests would be affected there.
