Summary
The claimant argues to be the legal successor of the publisher F E Nachf.-GmbH, a German Limited Company, who published the Nazi journals “Der Angriff” and “Völkischer Beobachter” in 1933. The respondent, an English Private Limited Company, distributed one issue each in the history magazine “Zeitungszeugen” in 2009. The claimant therefore claims for injunctive relief due to copyright infringement. The court applied German IP law referring to the lex loci protectionis in Art. 8 (1) Rome II Regulation.
