Summary
The parties concluded a contract of carriage. The goods were to be delivered from Germany to Libya. They argued about damage claims resulting from damage caused to the transported goods.
The court held that German law applied to the case pursuant to Art 5 (1) Rome I. Both the carrier and the consignor had their habitual residence in Germany and the goods were received there.
