Summary
The plaintiff requests the non-execution of a judgment delivered by a Spanish court of first instance. The main dispute is about a set-off and an assignment based on a purchase of debt. Regarding to the purchase of debt German law was applicable according to Art. 4 (2) as the administrator was seated in Munich, Germany. Concerning the assignment German law was applicable according to Art. 14 (2).
