Summary
The plaintiff (employee) and the defendant (employer) argue about the conclusion of an employment contract by the defendant. The plaintiff claims for payment of salary according to this contract. The court applied German law according to Art. 8 (2)(1) Rome I, because the plaintiff was habitually carrying out his work from Germany.
