Summary
The plaintiff is an association trying to prevent abusive behavior and has its seat in Germany. The defendant is a company selling flight tickets. The plaintiff is seeking injuctive relief trying to prevent the defendant from using its general terms. The court applied German law according to Art. 3 and Art. 5 Rome I Regulation because the parties did not sufficiently chose foreign law.
