Summary
The plaintiff and the defendant are businesses offering cruises in Egypt. The defendant has his seat in Egypt. The plaintiff argues that the defendant does not respect the obligation to provide for compulsory information on his website about the name, address etc. of the service supplier. The court held that Egyptian law was the law applicable to the contracts of the defendant according to Art. 6(4)(a), 4(1)(a) Rome I (making an exception from Art. 6(1) and (2) Rome I). Therefore - with regard to the country-of-origin principle - the court could not intervene in the advertisement of the foreign service supplier.
