Summary
The plaintiff is a consumer organization, the defendant is an Irish company. The plaintiff wanted to prohibit the use of some clauses of the defendant’s standard terms. The court applied German law to the question of validity of the standard terms in contracts with German consumers according to Art. 6 Rome I, because the standard terms do not contain a choice-of-law clause.
