Summary
The plaintiff is a German consumer. The defendant is a French airline. They argue about damage claims resulting from a delayed flight. The court held that German law is applicable to the claim under Art. 5 para. 2 Rome I because the plaintiff has its habitual residence in Germany and the flight started in Germany.
