Summary
The plaintiff is a buyer of life insurances and bought a life insurance from a German policy holder. The defendant is the insurance company. The parties argue about rights from the insurance contract. The court applied German law to the contract, because the policy holder and the defendant had stipulated a choice-of-law clause in favor of German law which was valid according to Art. 3 Rome I.
