Summary
The parties had concluded a settlement regarding maintenance obligations before a Polish court in 2005. The applicant, who lives in Poland, was seeking an amendment of the court settlement due to a deterioration of his financial circumstances. The creditor, who lives in Germany with his mother, brought a counterclaim requesting an increase in child support. The court applied German law pursuant to Art. 15 Maintenance Regulation in conjunction with Art. 3 (1) Hague Maintenance Protocol and recalculated the amount of maintenance due based on Eurostat's Purchasing Power Parities (PPP) statistics.
