Summary
The plaintiff is a producer of sport gadgets from Denmark. The defendant is a producer of sport gadgets from the United States. The plaintiff sued because of an alleged violation of its intellectual property rights. The question was whether the court has jurisdiction under the regulation 207/2009. The court asked the CJEu whether the criteria for a “branch” developed under Art. 5 Brussels I can also be applied under the reulation 207/2009.
