Summary
The following is a consumer contract case transacted before Spanish courts based on a law dispute concerning the application of Rome I Regulation provisions. The matter of the case is the application of Rome 1980 Convention or Rome I Regulation. One of the parties invokes the application of Rome 1980 Convention to the case. Court judgment: the court comes to the conclusion that neither Rome 1980 Convention nor Rome I Regulation are applicable to the case. The court only makes a generic reference to the non application of Rome I Regulation provisions to the case (the court does not cite any particular article of the Regulation (EC) No 593/2008).
