Summary
Key facts: Applicable law dispute in Spain. The matter of the case is the application of Rome I Regulation provisions on the law applicable to consumer obligations. One of the parties alleges the existence of unfair terms in a consumer contract. One party claims for the application of a regional Spanish law instead of Rome I Regulation provisions. Court judgment: the court decides that the Spanish regional law invoked by one of the parties is not applicable to the case. Regional law cannot be opposed to Rome I Regulation provisions and Spanish common law (in addition, national courts have an exclusive jurisdiction). The court only makes a generic reference to the application of Brussels I Regulation provisions to the case (the court does not cite any particular article of Regulation (EC) No 593/2008).
