Summary
Conflict of jurisdiction based on the application of Brussels I Regulation provisions. The matter of the case is a labour dispute originated by the dismissal of a Spanish worker by a Spanish branch of a financial American company. The services were provided in Spain. Court decision: the court decides that Spanish courts are competent to decide on the case according to arts. 18 and 19 of Brussels I Regulation. The court applies the rules on jurisdiction in matters relating to matters relating to individual contracts of employment. The court takes into account the provisions on jurisdtiction when an employer is domiciled in a Member State, which may be sued in the courts of the Member State where he is domiciled or in another Member State, in the courts for the place where the employee habitually carries out his work (Spain, in this particular case).
