Summary
Application of Brussels I Regulation provisions to the enforcement of a foreign court decision in Spain. The matter of the case is the enforcement of a foreign court decision in Spain. The plaintiff aksk for the adoption of precautionary measures on the basis of art. 47 of Brussels I Regulation. Court decision: the enforcement is accepted in as much as all the requirements of Brussels I Regulation are fulfilled. The precautionary measures requested by the plaintiff will be accorded in due time according to art. 47 of Brussels I Regulation. In order to decide, the court makes an effective examination of the formal requirements of Brussels I Regulation for the enforcement of a foreign court decision delivered by another Member State. The court only makes a generic reference to the application of Brussels I Regulation provisions to the case.
